Saira Banu settles long-pending property dispute with builder Sameer Bhojwani

Synopsis

Actor Saira Banu Khan has formally settled her long-standing property dispute with Mumbai builder Sameer Bhojwani, leading the Economic Offences Wing (EOW) to close the cheating and forgery case filed in 2018. The dispute involved a 2,412 sq yd plot in Bandra's Pali Hill area, near her residence. Banu stated in an affidavit submitted in 2022 that the matter stemmed from misunderstandings and had been amicably resolved. Following her statement, the EOW filed a closure report that was accepted by a magistrate. Another unrelated case against Bhojwani remains pending.

The Economic Offences Wing (EOW) of the Mumbai Police has officially closed the cheating and forgery case registered by Saira Banu Khan against builder Sameer Bhojwani and others. The investigation team submitted a C-summary closure report after the actress informed officials that the dispute had been resolved and that she no longer wished to pursue the matter. The magistrate accepted the EOW's report, marking an end to the case that had been under investigation for several years.


The dispute concerned a prime 2,412 sq yard property located at Pali Hill in Bandra West. Banu had filed an FIR in 2018 accusing Bhojwani and his associates, Mahendra Kishore Khatau and Hiten Abhay Khatav, of using forged documents to falsely claim ownership of the land. The allegations included cheating, forgery, and criminal conspiracy under various sections of the Indian Penal Code.

During the inquiry, Banu submitted a notarised affidavit-cum-undertaking dated October 20, 2022, stating that the misunderstanding had arisen from property-related issues between her late husband, legendary actor Dilip Kumar (Yusuf Khan), and Bhojwani. In the affidavit, she clarified that both parties had amicably and irrevocably settled their differences, and she no longer wished to pursue her earlier accusations of fraud or forgery.

The civil suit connected to the same property in the Small Causes Court was also settled mutually. Following the settlement, both sides agreed to cooperate in closing the criminal case. The EOW confirmed that after examining all records and Banu's affidavit, it found no need to continue proceedings and recommended closure, which the court subsequently approved.

However, builder Sameer Bhojwani continues to face a separate case filed by Divyakant Khatau, a member of the Khatau Trust. The complaint alleges that Bhojwani forged documents to claim ownership of another plot adjacent to Saira Banu's Pali Hill bungalow. In that case, the police have already filed a charge sheet, and the trial remains pending before the court.

The resolution of Banu's case concludes a long chapter of legal and personal disputes over the Bandra property, which had drawn attention due to the personalities involved and the high value of real estate in Pali Hill, one of Mumbai?s most expensive neighbourhoods.
