The Madhya Pradesh High Court has recently issued notices to multiple respondents, including two retired senior IAS officers, a businessman, the Bhopal municipal commissioner, the urban administration commissioner, the director of town and country planning, and the builder of houses in the 'Whispering Palms' society located near the Kaliyasot Dam in Bhopal.


This move comes after a petition raised concerns about unauthorized constructions in the area. Advocates representing the petitioners said that some residents carried out "blatantly illegal and grossly excessive" construction in a zone designated as ecologically sensitive. The petition indicated that these actions violated the Bhopal Master Plan-2005, which regulates low-density residential developments.

Under the plan, the low-density zoning requires a maximum floor area ratio (FAR) of 1:0.06, meaning that only 6% of each plot can be built upon. The minimum plot size in this zone is 10,000 sq ft, restricting construction to no more than 600 sq ft per plot. Petitioners claimed that some residents constructed over 5,000 sq ft, exceeding the approved limits by more than 50%.

The low-density rules were implemented to maintain ecological balance, manage urban planning effectively, and safeguard the Kaliyasot Dam's surroundings. Violations not only compromise these objectives but also threaten the area's safety and environmental sustainability.

The court has instructed all concerned authorities and respondents to review the situation, identify the unauthorized constructions, and take necessary steps to rectify the violations. A further hearing has been scheduled to monitor compliance and ensure that proper measures are implemented to prevent similar issues in the future.
