Haryana RERA orders refund after delayed flat possession

Synopsis

The Haryana Real Estate Regulatory Authority (HRERA) has directed Sarv Realtors to return INR 41.6 lakh with 11.1 percent interest to a couple who were denied timely possession of a 3BHK flat in Supertech Hues, Sector-68. The property was booked in 2014 under a possession-linked plan, with delivery due by 2017, yet the project remained incomplete well beyond the contractual deadline.

HRERA has ordered Sarv Realtors to reimburse Anirudh and Manali Gowalkar, along with 11.1 percent annual interest on the INR 41.6 lakh initially deposited, for failing to deliver their 3BHK flat in Supertech Hues, Sector-68. The couple had secured the unit in 2014 under a possession-linked payment plan, with possession promised by December 2017 and an additional grace period until mid-2018.


Despite repeated follow-ups, construction remained stagnant. In 2017 the buyers? unit was moved from Tower P to Tower O, yet progress stalled again. Matters worsened when Supertech transferred the project to Sarv Realtors without buyer consent, leaving purchasers in a prolonged wait.

Sarv Realtors argued that demonetisation, temporary construction bans, the Covid-19 pandemic, and the corporate insolvency of Supertech Ltd. were to blame for the delays. HRERA rejected these claims, noting that possession deadlines had expired years before the pandemic, and temporary restrictions could not justify an eleven-year delay.

Citing Section 18 of the RERA Act, HRERA instructed the developer to refund the sum with interest within ninety days, while also prohibiting the resale of the disputed unit until the amount is cleared.

By insisting on a refund with interest, the authority reinforced buyer protection and accountability in delayed housing schemes. For homebuyers, the ruling underscores the significance of legal recourse under RERA, while developers are reminded of the serious financial and reputational risks of failing to honour possession commitments.
