The Allahabad High Court has ordered the Ghaziabad Development Authority and local officials to halt demolitions of unauthorised homes, offering interim relief to residents facing eviction. The directive follows a petition by Naresh Kumar and 18 others, who've lived on the land for over 40 years. The court emphasised the need for a rehabilitation plan, noting the petitioners belong to economically weaker sections. Authorities must now submit a detailed resettlement proposal before the next hearing. Demolition notices had been issued to 172 occupants, sparking legal challenges. The court also barred structural changes and third-party claims until further orders are issued.

The Allahabad High Court has directed the Ghaziabad Development Authority (GDA) and local administration to halt demolition activities and preserve the current state of unauthorised properties in the city. This interim relief was granted in response to a writ petition filed by Naresh Kumar and eighteen other residents, who challenged the demolition notices issued under the Uttar Pradesh Urban Planning and Development Act.


The court acknowledged that the petitioners have been residing on the said land for over forty years and observed that they belong to the economically weaker sections. It noted that any forced eviction without providing a viable rehabilitation scheme would amount to severe hardship. Accordingly, the bench instructed the GDA and the district magistrate to prepare and submit a detailed rehabilitation plan for the affected individuals before the next hearing.

The demolition notices had reportedly been served to 172 occupants, of whom around fifty individuals filed objections. These objections were heard by the authorities, but no resolution was reached, prompting legal intervention. The court also made it clear that, pending further directions, no third-party rights were to be created over these plots and no alterations to the existing structures were to be undertaken by the petitioners.

The matter has now been listed for further hearing later this month, during which the proposed rehabilitation plan will be reviewed to determine subsequent action.
