Maharashtra's Charity Commissioner, Amogh Kaloti, has intervened to stop the sale of a 12,000-square-meter property in Pune's Model Colony owned by the Seth Hirachand Nemchand Smarak Trust. The property, which includes a Jain boarding facility and Mahavir Digambar Jain Temple, was set to be sold to Gokhale Constructions for INR 311 crore. Opposition from sections of the Jain community led to the intervention, with the Commissioner ordering a 'status quo' and seeking a detailed report. The trust maintains that all legal processes were followed during the sale.
Maharashtra's Charity Commissioner, Amogh Kaloti, has ordered a halt on the sale of a prime property in Pune's Model Colony. The 12,000-square-meter property, owned by the Seth Hirachand Nemchand Smarak Trust, accommodates a long-standing Jain boarding facility and a Mahavir Digambar Jain Temple. The trust had agreed to sell the property to Pune-based Gokhale Constructions for INR 311 crore.
The planned sale faced opposition from parts of the Jain community, who raised concerns that the sale violated the trust's charitable objectives. Advocate Yogesh Pandey, representing the petitioners, stated that the boarding facility was created to provide education and accommodation to students, and its sale or redevelopment would contravene charity law. He emphasized that maintaining the property's current status was crucial to safeguard the interests of students and uphold the trust's original purpose.
Following these concerns, Charity Commissioner Kaloti directed that no transaction, construction, sale, or transfer of the property should take place until further notice. Additionally, the Commissioner has requested a detailed report on the matter to assess the situation thoroughly.
The Seth Hirachand Nemchand Smarak Trust has denied any wrongdoing, stating that all legal procedures were followed during the execution of the sale and that the decision was in line with the trust's regulations. The intervention reflects the regulatory authority's role in ensuring that the charitable objectives of long-standing institutions are protected while balancing property development interests.
