Delhi International Airport Limited (DIAL), part of the GMR Group, has approached the Supreme Court to challenge a Delhi High Court decision that directed GMR Group Chairman GM Rao to vacate his residence at Pushpanjali Farms. The High Court had ruled that the lease agreement between DIAL and the previous property owner had been terminated, and the land, purchased by Onkar Infotech, should be handed over. DIAL argues that the property serves mixed purposes, and the unregistered lease creates ambiguity over possession. The case raises broader questions on unregistered leases and land reforms.
Delhi International Airport Limited (DIAL), a company managed by the GMR Group, has filed an appeal in the Supreme Court to challenge a recent decision by the Delhi High Court concerning Pushpanjali Farms. The High Court had instructed GMR Group Chairman GM Rao to vacate the 2.45-acre property and hand it over to Onkar Infotech, which now holds ownership.
The issue dates back to an unregistered lease agreement signed in 2020 between DIAL and Indus Sor Urja, the then-owner of the property. In 2024, Onkar Infotech acquired the property for INR 115 crore, receiving all rights previously held by Indus Sor Urja. Following this purchase, Onkar Infotech served a 15-day notice to DIAL, asking them to terminate the lease and surrender possession of the land.
DIAL contested the termination, claiming the property had a dual purpose-serving as a residential space for GM Rao and remaining agricultural land for other uses. The company argued that due to the mixed use and the unregistered nature of the lease, the property should be partly protected under the Delhi Land Reforms Act, 1954. The Delhi High Court rejected this reasoning, stating that the residential portion of the land did not fall under the Act and that the unregistered lease could not provide legal authority for DIAL's continued possession.
Following this ruling, DIAL moved the Supreme Court seeking to overturn the High Court order. The appeal emphasizes the legal complications arising from unregistered leases, mixed-use properties, and the interpretation of land reform laws. Legal experts note that the Supreme Court's decision could set a significant precedent for how unregistered leases and similar property disputes are handled in India.
