The Odisha Real Estate Regulatory Authority (ORERA) has introduced revised guidelines to improve the efficiency of its Conciliation and Dispute Resolution (CDR) cell. These guidelines focus on resolving disputes between homebuyers, promoters, and agents under the Real Estate (Regulation and Development) Act, 2016. The framework sets out procedures for initiating conciliation, timelines for resolution, fees, and the binding nature of agreements. ORERA's move reflects its ongoing effort to make real estate regulation more transparent, reduce legal delays, and ensure fair treatment for all parties involved in the state.
The Odisha Real Estate Regulatory Authority (ORERA) has updated its guidelines to make the operations of the Conciliation and Dispute Resolution (CDR) cell more effective and structured. The aim is to help homebuyers, promoters, and agents settle disputes amicably, reducing the need for lengthy legal proceedings.
Under the new rules, disputes that fall within the scope of the Real Estate (Regulation and Development) Act, 2016, can be referred to the CDR cell either by ORERA itself or through an application by any party involved. Conciliation can only proceed with the consent of both parties. Once consent is granted, the party initiating the process is required to pay a nominal fee of INR 500 to the ORERA secretary. Following this, the CDR cell schedules a hearing and informs both parties of the date, time, and venue.
The guidelines require the CDR cell to resolve disputes within a two-month period. Both parties must attend the hearings, and if a settlement is reached, it is recorded in writing and signed by both sides, making it legally binding. If any party fails to comply with the agreed terms, ORERA can take appropriate action, which may include initiating formal legal proceedings.
These guidelines are part of broader efforts to strengthen real estate governance in Odisha. Earlier this year, ORERA's enforcement powers were enhanced, including the integration of digital land records and real-time project approvals to streamline operations and monitoring. This ensures greater transparency, accountability, and confidence among buyers and developers in the state.
