The Bombay High Court recently dismissed a review petition filed by the Motilal Nagar Vikas Samiti, thereby clearing the way for the substantial redevelopment of 141 acres of MHADA land in Goregaon West, Mumbai. Adani Realty has been appointed as the Consultant and Development Agency for this project, estimated to cost INR 21,000 crore. The court reaffirmed MHADA's right as the landowner to appoint private developers through competitive bidding. This decision, which follows earlier legal actions over illegal constructions, allows the large-scale housing redevelopment to proceed, with the developer covering costs for transit, rehabilitation, and related amenities for eligible residents.
The Bombay High Court recently dismissed a review petition filed by the Motilal Nagar Vikas Samiti, a resident group. This decision clears the way for the redevelopment of 141 acres of land belonging to the Maharashtra Housing and Area Development Authority (MHADA) in Goregaon West, known as Motilal Nagar.
MHADA has appointed Adani Realty as the Consultant and Development Agency (CDA) for this extensive project. The redevelopment is being positioned as one of Mumbai's largest housing initiatives, with an estimated cost of around INR 21,000 crore. The developer will cover all project expenses, including the cost of transit homes, rehabilitation of eligible residents, and associated amenities.
The resident group had challenged an earlier High Court ruling from March of this year, citing various procedural and legal points. They argued that resident societies should be allowed to undertake self-development under government policy, or be permitted to appoint their own developers under specific regulations. They also contended that 51 percent consent from members was required for redevelopment.
However, the court found that no new legal grounds were presented by the resident group. It reaffirmed MHADA's right as the landowner to invite bids and appoint private developers. Adani Realty was selected for the project through a competitive bidding process.
With the review plea now dismissed, MHADA can proceed with the redevelopment of Motilal Nagar I, II, and III. This project was initially spurred by Public Interest Litigations (PILs) filed over a decade ago, in 2013, which sought action against widespread illegal constructions within the 400-tenant colony. Those PILs were later closed as part of MHADA's broader redevelopment plan for the area.
A detailed order from the High Court regarding this decision is expected to be released later. This ruling marks a significant step forward for a project crucial to addressing Mumbai's housing needs and urban renewal.
