The Bombay High Court has directed 11 dissenting residents of the Deepanjali and Pushpanjali Cooperative Housing Societies in Vasai (West) to vacate their structurally unsafe homes within 15 days, enabling demolition and redevelopment. The Vasai Virar Municipal Corporation had already classified the four buildings as dangerous, a finding confirmed by a technical committee. Of the 113 residents, most supported redevelopment, but a small group objected. The court ruled they may pursue their objections legally but cannot stall demolition, adding that police assistance may be sought if evacuation is resisted.
The Bombay High Court has instructed 11 residents of four unsafe housing blocks in Vasai West to vacate their flats within 15 days, clearing the way for redevelopment. The court extended the timeline in consideration of the ongoing Ganesh festival but made it conditional, requiring each resident to give a written undertaking to leave without further resistance. If they fail to do so, the Vasai Virar Municipal Corporation (VVMC) has been permitted to seek police help to ensure evacuation.
The four buildings, Pushpanjali CHSL and Deepanjali CHSL, located in Diwan and Sons Housing Enclave on Ambadi Road were declared structurally dangerous after VVMC's survey in February. A Technical Advisory Committee confirmed the findings in June, and official notices to vacate were issued in July.
Out of 113 flat owners, nearly 90 per cent had already agreed on redevelopment and appointed a developer. The 11 dissenting residents admitted that structures were unsafe but raised objections to the redevelopment process. The court stated that they had the right to contest their issues in an appropriate forum but could not obstruct the demolition or delay redevelopment at the cost of public safety.
VVMC's counsel argued that the lack of cooperation from these residents might necessitate stronger measures, and the court agreed to grant the 15-day extension only if a binding undertaking was filed. Without it, VVMC has the option to proceed with police assistance.
This order follows similar action taken in September, 2024 in Vasai East, where 41 unauthorised buildings were demolished after being found on land reserved for civic amenities. That operation displaced several families and led to court directions on rehabilitation. Since then, the authorities have been under increased pressure to act decisively against unsafe and illegal constructions across the Vasai-Virar region, with public safety highlighted as the priority.
