The Goa Real Estate Regulatory Authority (RERA) has recently issued a comprehensive circular targeting misleading and vague advertisements by real estate developers. This significant initiative aims to enhance consumer protection and instill greater transparency and accountability in the state's real estate market. The new guidelines prohibit the use of broad disclaimers like "terms and conditions apply" and mandate that all project promotions, including those on digital platforms and billboards, must prominently feature the project's official Goa RERA registration number and the authority's website. Developers are now also required to provide specific, verifiable details about amenities and are banned from using variable measures like travel time.
The new guidelines from Goa RERA are a direct response to a rise in consumer complaints about deceptive marketing practices. The authority has explicitly banned developers from making non-specific promises, such as listing a number of amenities like "11+ amenities," unless each one is clearly detailed and verifiable. This is a crucial step towards ensuring that the information provided to consumers is truthful and holds up to scrutiny.
A key requirement of the new circular is the mandatory inclusion of the RERA registration number on all advertisements. This applies across all media, from print and electronic to social media, brochures, and hoardings. The registration number must be displayed in the top right corner of the advertisement. This makes it easier for potential buyers to verify a project's legitimacy directly on the RERA website, giving them an important tool for due diligence.
Furthermore, to eliminate ambiguous claims, the guidelines prohibit the use of travel time in advertisements, as it can be influenced by traffic conditions. Instead, developers must now state the project's exact location as per the officially approved plans. This ensures that the location information is precise and cannot be misrepresented.
For non-compliance, developers could face penalties under the Real Estate (Regulation and Development) Act, 2016. These measures are a strong signal that RERA is committed to creating a fairer and more transparent market for both consumers and developers who follow the rules. This crackdown also comes amid broader efforts in Goa to protect flat buyers from builder malpractices and to streamline the transfer of land to housing societies.
